Defense Win for Oliver, DeLisle and Saunders

Shareholders Tom Oliver and Sara Beth DeLisle and Associate Anna Saunders recently obtained partial summary judgment on behalf of a major transportation client in a lawsuit arising out of a motor vehicle accident involving a tractor-trailer and passenger vehicle in Calhoun County.  The plaintiff alleged she was injured due to the defendant driver’s negligent and wanton operation of a tractor-trailer.  The plaintiff also asserted claims of negligent and wanton entrustment, hiring and training against the motor carrier.

 

On a motion for partial summary judgment, the defendants successfully argued that the defendant driver’s conduct did not support a claim of wantonness , and that the defendant driver’s record did not support claims of negligent/wanton entrustment, hiring and training.  The court dismissed those claims.
