Martin and Miller Obtain Dismissal

Sean W. Martin and Chancey R. Miller obtained dismissal of premises liability case that was upheld on appeal.  The plaintiff claimed she fell through the HVAC floor vent in an upstairs bedroom.  She sued the owner and apartment management company for premises liability and negligence per se for violation of building codes.  After multiple motions and amendments to the complaint, the trial court ultimately dismissed all claims against all defendants.  The plaintiff appealed and the Tennessee Court of Appeals affirmed the decision.

Baggett and Ingram Prevail on a Motion for Judgement

Evan Baggett and Josh Ingram of our Birmingham (AL) office recently prevailed on a motion for judgment on the pleadings in a complex tort case. After extensive briefing and oral arguments, the court granted their motion and dismissed all the plaintiff’s claims with prejudice.
