Kirkpatrick and Avery successfully defend fibromyalgia case

The team of Bo Kirkpatrick and Dan Avery recently and successfully defended a fibromyalgia case pending in Etowah County, Alabama.  The plaintiff asserted she was permanently and totally disabled from an on the job injury which caused her fibromyalgia.  The court, following a trial on the merits, did not agree, and rendered a defense verdict, holding that the plaintiff failed to prove that her condition was related to her employment.
