Ireland, Moss, Palmer and Stokes Obtain Summary Judgment

Carr Allison’s Charlie Ireland, Hannah Stokes, Walker Moss, and Stephen Palmer of our Birmingham (AL) office obtained summary judgment in a case arising out of the allegedly wrongful public auction and sale of the Plaintiff’s personal property that was stored at the Defendant’s self-storage facility. Defense counsel argued that the Defendant not only followed the applicable State law and its contractual obligations, but also went above and beyond its duties by attempting to notify the Plaintiff on multiple occasions about the impending auction and giving her additional opportunities to cure her default. The case was dismissed with prejudice.
