Miles Wood Igou of our Jacksonville (FL) office was granted a motion for summary judgment on a case involving a slip and fall in the parking lot of a national convenience store chain. At her deposition, the plaintiff admitted that she began to fall before reaching the alleged condition. In the motion, Miles argued that the plaintiff had a duty to use due care to protect her own safety as she was aware of the allegedly dangerous condition, and that the alleged condition did not cause the alleged incident. Ultimately, the court agreed and granted his motion.
