Shareholders Heather M. Houston and Jonathan R. Maples of Carr Allison’s Mobile, AL office successfully petitioned the Supreme Court of Alabama to order the trial court to dismiss all claims against their client, a roadway sweeping contractor, based upon the applicable statute of limitations. Houston and Maples successfully argued that the “relation back” doctrine did not save the plaintiffs’ claims against their client. The Supreme Court of Alabama issued a writ of mandamus directing the trial court to dismiss all claims against their client.
