Stephen A. Swanson of our Chattanooga (TN) office obtained summary judgment in Fulton County (GA) on behalf of a restaurant client in a lawsuit stemming from a customer-server altercation. The plaintiffs brought 12 claims, ranging from battery and false imprisonment to negligent hiring and emotional distress. The court dismissed the action in its entirety, holding that the server’s conduct fell outside the scope of employment, there was no evidence of notice of any violent history and the plaintiff who initiated the physical confrontation was a mutual combatant.
