Alison H. Sausaman and Andrew-Paul Griffis of our Jacksonville (FL) office secured a complete defense victory on behalf of a national convenience store and gas station in federal court. The plaintiff alleged injuries resulting from a transitory foreign substance on the premises.
Alison and Andrew-Paul successfully obtained final summary judgment after the court found there was insufficient evidence to establish constructive notice, concluding that the substance had not been present long enough for the defendant to discover and remedy the condition. The court dismissed the case in its entirety.
