Martin Obtain Full Dismissal

Carr Allison shareholder Sean W. Martin of our Chattanooga (TN) office, obtained a full dismissal of a complaint against the firm’s retail hospitality industry client in the United States District Court for the Middle District of Tennessee.

In the complaint, the Plaintiff alleged that the store negligently placed hooks on a product display of mats.  When the Plaintiff grabbed one of the mats, one of the hooks fell on his foot causing neuropathy.  A motion to dismiss was filed in lieu of an answer.  The motion was granted and the case was dismissed with prejudice.  No appeal was taken.
