Martin and Swanson Obtain Full Dismissal

Carr Allison attorneys Sean W. Martin and Stephen A. Swanson of our Chattanooga (TN) office, obtained a full dismissal with prejudice for a national auto parts store in a case pending in Gwinnett County, Georgia.

The case involved an auto accident with a car allegedly leased to Carr Allison’s client and driven by one of its employees.  However, Mr. Martin and Mr. Swanson determined that the license plate entered on the police report did not match the VIN number or the vehicle described.  In addition, the driver was not an employee of Carr Allison’s client.  The case finally broke when Mr. Martin and Mr. Swanson obtained GPS data from the actual vehicle, which was at all times in Virginia at the time of the accident.  This led to a full dismissal.
