Carr Allison shareholder Tara W. Lockett of our Mobile (AL) office obtained a defense verdict in an Ex parte Publix trial on compensability where the plaintiff argued the injuries sustained to his right shoulder while at work resulted in a need for a total shoulder replacement. As a result of the total shoulder replacement the plaintiff argued he was constantly in pain and was unable to work. The court found in favor of Tara’s client agreeing the plaintiff sustained a temporary aggravation of a pre-existing condition and entered an order for a defense verdict.
