Huffman Earns Summary Judgment in MS

Gulfport Counsel Nikki Huffman obtained summary judgment dismissing a claim against a trucking client.  The Complaint was filed in early 2018 against a trucking client and its employee driver, regarding a collision that took place in Harrison County, Mississippi.  Early on, the Plaintiff attempted to improperly default the employee driver.  Recognizing the service issues, Nikki was able to obtain a dismissal, with prejudice, of the employee.  Nikki continued discovery and motion practice, culminating in a Motion for Summary Judgment attacking the Plaintiff’s repeated and dilatory failures with regard to answering discovery.  Despite Plaintiff’s counsel’s suggestion of sanctions against himself as a lesser alternative, the Court dismissed the entire case with prejudice.  Plaintiff did not appeal.
