Dunagan Obtains Summary Judgment

Carr Allison Shareholder Greg Dunagan of our Daphne (AL) office recently obtained a summary judgment award for a police officer in a case alleging a claim under the Alabama Municipal Tort Liability Act and a claim of false imprisonment.  The Plaintiff alleged that she had been wrongfully questioned by the officer regarding suspicious activity that a local bank had seen on its outside security cameras and which it requested the officer to further investigate.  The Plaintiff was only briefly questioned and was cleared and never charged with any offense.  The Court agreed that the officer was acting within his duties as a police officer in questioning the Plaintiff and determined that he was entitled to immunity from liability.  On this basis, the Court granted summary judgment and dismissed the case.
