Cutshall Obtains Win

Birmingham Shareholder Amanda Cutshall obtained a denial of compensability while defending a workers’ compensation case in Marshall County, Alabama.  The Plaintiff asked the Court to determine whether his employer would be liable for a second injury to his left shoulder.  Ms. Cutshall argued that Plaintiff failed to provide the proper notice as required by the Workers’ Compensation Act of Alabama. At the conclusion of the compensability hearing the Judge agreed, ruling that the Defendant could not be held liable for the injury under the Workers’ Compensation Act.
