Weaver and Concilla Obtain Dismissal

Carr Allison attorneys Kyle Weaver and Nick Concilla of our Tallahassee (FL) office, recently obtained a dismissal with prejudice on behalf of their clients in a novel injury claim asserted by the plaintiff.  The plaintiff alleged she suffered a miscarriage while on the job.  The complaint alleged a negligence claim against the plaintiff’s employer, but Kyle and Nick moved to dismiss the case because the plaintiff’s sole remedy was under Florida’s workers’ compensation system rather than any recovery in tort.  After a hearing on the issues, the Court granted the Motion and dismissed the case against Carr Allison’s client with prejudice.
