Nixon Successfully Defends Client

Carr Allison shareholder Faith Nixon of our Mobile (AL) office successfully defended her client in a Circuit Court jury trial in Mobile County (AL).  The Plaintiff claimed Mrs. Nixon’s client was channeling stormwater onto the Plaintiff’s property, causing substantial structural issues with the home and rendering the property valueless.  Mrs. Nixon defended the claims by showing that the Plaintiff’s home was in the natural drainage basin for the stormwater runoff from the nearby subdivision and that no actions on the part of her clients increased the natural flow of water.  Plaintiff asked the jury to award $450,000 for loss of value of the property ($205,000) and mental anguish.  The jury returned a defense verdict for Mrs. Nixon’s client.

Alison H. Sausaman of our Jacksonville (FL) office prevailed on a motion for summary judgment in federal court on behalf of a national convenience store chain. The court agreed that rain on an asphalt parking lot was not a dangerous condition and granted final judgment in our client’s favor.
