Nixon Obtain Summary Judgment

Carr Allison shareholder Faith Nixon of our Mobile (AL) office obtained a summary judgment for her client.  The Plaintiff, a disabled veteran, claimed that he was deprived use of his service dog in violation of the American with Disabilities Act and the Fair Housing Act by being required to place the dog on a leash.   Mrs. Nixon defended her client by showing that the Plaintiff could use his service dog, however, the law required that the dog be leashed whenever it was not actively performing a service.  The Plaintiff failed to demonstrate that the dog could not perform its services on a leash.  The Court granted summary judgment on all claims in favor of Mrs. Nixon’s client.
