Taylor and Dowdy Obtain Defense Verdict

Carr Allison attorneys Jeremy Taylor and Mark Dowdy obtained a defense verdict for a trucking client in federal court in Mobile, AL.  The Plaintiff in the case argued that the tractor trailer driver made an improper right hand turn, had an insufficient amount of reflective tape and placed tape on the trailer at an inappropriate height.  Taylor and Dowdy countered, arguing that the Plaintiff was checking texts immediately before the accident, that nothing about the turn was inappropriate, that the tape on the trailer was sufficient and that the Plaintiff had ample opportunity to avoid striking the lead vehicle with the right of way.  It was also argued that the Plaintiff’s claimed injuries stemmed solely from pre-existing conditions, such that the Plaintiff was not injured as a result of the accident.  Following a four day trial, judgment was entered for the Defendants, with the Plaintiff taking nothing.
