Huffman Obtains Summary Judgment in Two Premises Liability Cases

Nikki Huffman, counsel in Carr Allison’s Gulfport (MS) office has obtained summary judgment in two premises liability cases.  The first case, out of Harrison County, involved a woman who fell while walking at a local shopping center.  Nikki argued that slightly uneven sidewalk blocks are not dangerous conditions as a matter of law.  The Court agreed and dismissed the case with prejudice.  The second matter, out of Wayne County, involved a man who slipped and fell while entering a bank’s covered walkway during a rain event.  Nikki argued that there was no accumulation of rain, that the bank had no notice of any alleged accumulation of rain and that a premises owner does not have a duty to remove rainwater as quickly as it falls.  The Court agreed and dismissed the case with prejudice.
