Win for Nixon!

Faith Nixon of the Mobile office successfully defended her client, an insurance company, in a circuit court jury trial in Escambia County, Florida. The matter involved a clear liability car accident in which the driver fled the scene of the accident after the collision. The driver was uninsured and a default judgment was taken against him. The Plaintiff filed an uninsured motorist claim against his insurer claiming that he had nerve damage (brachial plexus injury) as a result of the accident and suffered numbness in his left hand. He sought damages for medical expenses and non-economic damages including permanent impairment, past and future pain and suffering, mental anguish and loss of enjoyment of life. Ms. Nixon defended her client, the insurer, arguing that the Plaintiff was a former rodeo clown and the majority of his claims were either contrived in order to increase his recovery or due to a pre-existing injury. The jury returned a verdict for medical expenses less than what was requested by Plaintiff and only awarded $500 in past and future non-economic damages. The total verdict was less than what was previously offered to Plaintiff to settle his claims.
