Nixon Earns Defense Verdict

Shareholder Faith Nixon of Carr Allison’s Mobile, AL office successfully defended her client, an insurance carrier, in a circuit court jury trial in Baldwin County, AL.  The Plaintiff claimed that she was injured in a rear end collision and as a result had to undergo spinal surgery.  The driver of the other vehicle involved in the accident settled her claims pre-suit, so the case proceeded as an underinsured motorist claim against the insurance carrier.  The Plaintiff sought damages for medical expenses and pain and suffering while her husband sought damages for loss of consortium.  Ms. Nixon proved the accident did not cause the Plaintiff’s injuries by providing evidence of the lack of damage to the vehicle and evidence of the Plaintiff’s pre-existing conditions.  The jury deliberated only 23 minutes before returning a verdict in favor of the insurance carrier.
